What is the Constitution?
May be described like fundamental law: law determining the fundamental political principles of a government, The written instrument embodying the fundamental principles of the state that establishes power and duties of the government and guarantees certain rights to the people.
Well yeah here we are just in circles over the constitution reforms after years of going in circles. Former president Moi did just declare that and I quote "...mtazungushwa miaka yote kabla kupata katiba..." That’s a really disturbing confession and leaves much to imagination. One would ask was or is this issue of constitution lucking people and leaders committed to execute or make it workable. And true to his words we still groping around hoping that one day the constitution would finally be here.
Lets look at the situation clearly, what’s really stopping us from having the constitution if it isn’t the political class? For a fact they all have their interests vested in the document to which they feel like they would rather shove them down our throats. One thing they are forgetting is the document shall live past them to the future of their families, but again maybe it’s for the families. Why is it more important to them than the interest of the Kenyan population?
In 2005 Kenyans went to referendum all so convince to be voting for the right cause but was it? From what could see and tell it was more of political games and power proving. Fundamental issues are never discussed rather politicized and rallying communities to believe its against them for sure is that what Kenyans would wish to live up to. Seems the trend when politicians does anything or feels like he is pinned on something he runs to his people and starts to claim its them being targeted, shame on them.
In away the civil communty is also failing, this is because why should they wait till election or the referendum time for them to educate Kenyans about the constitution I think this is the time. Make us understand on such matters like devolution, dual citizenship, religion, gender issues, all these are in the top most document. With a proper understanding way from the political influence would make Kenyans prepared for the such events like referendum. I say again this is the perfect time for the civic education we need it right now.
Looking at what happened to the document I tend to agree with some scholars on the fact of letting professionals to rewrite the document now including issues and correcting the few contentious issues. From examples the constitution of the most powerful nation in the world was not written by them for heaven sake, US got the material needed and it was written in Japan. (I stand to be corrected). We have lost trust with our own people why not try it written out there? Just to ensure transparency.
I believe with well educated civic nation we are prone to bring the required revolution and a new constitution would live to protect it.
